OUR BUSINESS CONDITIONS OMNIMEDICA Group AG GENERAL BUSINESS CONDITIONS
Validity
These General Terms and Conditions (GTC) apply to all purchase and supply contracts concluded via the Omnimedica Group AG website. Deviations from them are only valid with the express written consent of Omnimedica Group AG.
Conclusion of contract
The contract between the purchaser and Omnimedica Group AG is only concluded when Omnimedica Group AG accepts the customer's order. The buyer's order is placed online on the Omnimedica Group AG website. If Omnimedica Group AG does not reject the order within 72 hours, it is deemed to have been accepted.
Delivery
The order will be processed within two working days. Shipping is always carried out by DHL (A-Post). The buyer will be notified if delivery cannot be made within one week. No claims for delay or compensation can be derived from a delay in delivery.
Minimum order value
The minimum order value is CHF 1.
Prices
All prices are in Swiss francs, including statutory value-added tax. All prices quoted on the Internet, i.e. on the Omnimedica Group AG website, are non-binding. Prices and models are subject to change at any time without prior notice and without giving reasons. Omnimedica Group AG reserves the right to adjust prices accordingly in the event of price increases, additional fiscal charges, increases in customs duties or major currency fluctuations during the course of order processing.
Shipping costs
Deliveries within Switzerland by shipping service provider: Omnimedica Group AG charges a flat-rate shipping fee for orders under CHF 80. From an order value of CHF 80, Omnimedica Group AG pays the shipping costs. Deliveries outside Switzerland always include postage and customs clearance costs: Omnimedica delivers outside Switzerland against prepayment. You will receive a total invoice including actual shipping costs after receipt of your order.
Payment methods
- In Switzerland: Against invoice, bank transfer or with PayPal
- In Germany: Against prepayment, with PayPal
- Other countries: Against prepayment by bank transfer, PayPal
Complaints
Omnimedica Group AG will only replace goods that can be proven to have been damaged during order processing. Excluded from this guarantee are damages that occurred during transportation or upon receipt of the ordered goods.
Incorrect deliveries, quantity deviations and recognizable defects must be reported in writing to Omnimedica Group AG immediately, but no later than 2 working days after receipt of the goods. Hidden defects can be reported in writing up to one year after receipt of the goods at the latest. Returns will only be accepted after prior agreement, in complete condition and with a copy of the invoice enclosed. The buyer is responsible for proper transportation. Shipping costs for the return shipment shall be borne by the purchaser. Omnimedica Group AG shall decide at its own discretion whether a defective delivery is to be repaired or replaced in whole or in part. All other warranty rights are expressly excluded. In particular, Omnimedica Group AG is not liable for direct or indirect damage.

Liability for technical problems
To the extent permitted by law, Omnimedica Group AG accepts no liability for damages arising from temporary or permanent technical problems and/or failures in the operation of its website, e-mail traffic or other technical facilities. In particular, any liability for interruptions in transmission, data loss, security deficiencies, etc. is rejected. Omnimedica Group AG shall also not be liable for gross negligence and/or intent in the event of improper action and disregard of the risks on the part of the customer or third parties, improper use and/or unsuitable operating resources on the part of the customer or third parties, force majeure, environmental influences, interventions by the purchaser or disruptions by third parties, infestation by harmful programs such as viruses, etc. Omnimedica Group AG shall also not be liable for gross negligence and/or intent.

Data protection regulations
Omnimedica only stores the data that is necessary for business transactions. All personal data will of course be treated confidentially. If customers no longer agree to the storage of their personal data or if it has become incorrect, we will arrange for the deletion of such data upon notification. Upon request, customers will receive information about all data stored by us.
Place of jurisdiction
The provisions of substantive Swiss law, in particular the Swiss Code of Obligations, shall apply. The place of jurisdiction is in Switzerland, in Schlieren ZH. CH-8952 Schlieren, January 1, 2023
